1. Baseline USCIS Petition Processing Times
Before country-specific backlogs apply, every investor must have their initial petition reviewed by USCIS. The average processing time depends heavily on the project category:
- Rural TEA Set-Aside (Form I-526E): 3 to 18 months. Under the RIA, rural projects receive mandated priority processing, making them the fastest path to a conditional Green Card.
- Standard Regional Center (Form I-526E – Unreserved): ~32.5 months. * Direct EB-5 Investments (Form I-526): ~33 months.
2. EB-5 Timelines and Backlogs by Country

Once your priority date is current, your final processing phase depends on where you are physically located:
- Adjustment of Status (Form I-485): If you are already in the U.S., this process takes 6 to 18 months. If eligible for concurrent filing, you can live, work, and travel freely while waiting.
- Consular Processing (DS-260): If you are outside the U.S., your case goes through the National Visa Center (NVC) and your local embassy. This typically takes 6 to 12 months, depending heavily on local consulate backlogs.
