The TN visa is restricted to Canadians and Mexican professionals who will work in those categories listed in the NAFTA treaty.

The criteria are:

(1) It must be a position that is set out in the NAFTA list. (See below)

(2) The applicant must have the qualifications- need to show original degree or original proof of graduation or original documentation of licenses or letters confirming experience

(3) The employer’s position must need a person with the skill set of a professional.

(4) The beneficiary is going to work for a U.S. employer.

The initial intent of the TN category was to make it easy for professionals to move in and out of the U.S. to work. Over the years, because of some abuse, this visa has become very hard to obtain if the applicant fails to prepare.

An application is made at a border crossing or airport when the applicant is in route to the U.S.. Basically the applicant needs to perform live in front of a skeptical U.S. border patrol officer.

An application now requires an elaborate letter in support describing the U.S. company, its size and ownership, the position, the actual work done in the position, any subordinates, the place of work, the compensation and why the visa is needed for the length of time requested. Also all proof of education or experience must be in original formats

The standards for the visa vary from year to year, from one border crossing to the other and even among the staff on duty at the border crossing. The border patrol officer may search the applicant, the location of the office of employment as well as the company on the internet. Applicant’s wallets and papers can be physically searched and employers called.

The U.S. border patrol regularly revokes the TN visa when the applicants cross back to the U.S. at Christmas, any holiday and at other random times.

The visa can be granted for up to 3 years and supposedly renewed many times. The renewals can be obtained at a border crossing, airport or by remaining in the U.S. and filing a I-129 with the USCIS in the U.S. .

The spouse and dependents obtain a TD visa.
